Why deadlines matter

Removal orders are issued under section 24(1) of the Buildings Ordinance. The Buildings Department states that the maximum penalty for not complying is a fine of $200,000 and one year's imprisonment, plus a further fine of up to $20,000 for each day the offence continues.

Common questions

I have received a removal order. What should I do first?

Check the order number, the locations, what is required and the deadline, and keep every attachment. Don't arrange removal from the title alone: first confirm that the site matches the scope of the order, then decide the works and the reply.

What do I need before removing unauthorised works?

The full order, photos of the whole structure, where it connects to the main structure, its dimensions and how to access it. If it involves work at height, scaffolding, structure or shared services, arrange the right professional assessment first.

What should I do after receiving a repair order?

Check the deadline, the defective locations and what is specified, then arrange a site inspection. Depending on the problem, a registered contractor, an Authorized Person or a Registered Structural Engineer may be needed. Keep photos, reports and submission records afterwards.
